Terms of use

These terms describe the intended use of the public EMBOK website, resources, and self-guided assessment.

Last reviewed:

Requires legal review: Confirm the contracting legal entity, business address, legal contact, effective acceptance language, governing law, dispute process, warranty disclaimer, liability allocation, and any jurisdiction-specific consumer or business requirements before publication as final terms.

Using the website

By using the public site, you agree to use it lawfully and in a way that does not interfere with its operation or the rights of others. If you do not agree with the final approved terms, do not use the site. A paid diagnostic, advisory engagement, software pilot, or other service requires a separate written agreement; these website terms do not replace that agreement.

Assessment and informational content

The free assessment provides a directional self-reported signal based on the answers entered. It is not an audit, certification, benchmark guarantee, professional legal opinion, security assessment, or substitute for an evidence-based enterprise diagnostic. Results and recommendations may not fit every organization and should be evaluated with appropriate business, legal, privacy, security, data, and technology stakeholders.

Articles, frameworks, examples, and demonstration data are provided for general information. They do not promise a particular operational, financial, compliance, or performance outcome.

Product previews and roadmap statements

Product previews, illustrative dashboards, capability concepts, status labels, and roadmap statements explain the intended direction of EMBOK. They are not a commitment that a feature, integration, benchmark, or service is generally available or will be delivered by a particular date. Purchasing decisions should be based only on capabilities and terms confirmed in a separate written agreement.

Acceptable use

You must not:

  • Attempt to gain unauthorized access, bypass security, overwhelm the service, or disrupt another person's use.
  • Submit malicious code, deceptive requests, unlawful material, credentials, or confidential data you are not authorized to share.
  • Use automated means to scrape, copy, or reproduce substantial portions of the site contrary to applicable law or an approved written licence.
  • Misrepresent an EMBOK assessment result as an independent audit, certification, endorsement, or guaranteed benchmark.
  • Use EMBOK names, marks, content, or interfaces in a way that falsely suggests sponsorship, partnership, or affiliation.

Content and intellectual property

Unless a page or separate licence says otherwise, the website's original text, assessment design, framework presentation, visual system, and software are reserved by their respective owner. Limited personal or internal business use does not transfer ownership or permit republication, resale, or the creation of a competing branded assessment from protected material.

Third-party names and marks remain the property of their owners. Mention of a platform or vendor is descriptive and does not imply partnership, certification, or endorsement.

The site may rely on hosting, email, analytics, or other providers and may link to third-party resources. Their availability, security, content, and practices are outside EMBOK's direct control and are governed by their own terms and notices.

Availability and responsibility

EMBOK may correct, change, suspend, or remove public content and features. The site may occasionally be unavailable or contain errors. To the extent permitted by applicable law and subject to the final legally approved terms, use of the public site is at your own risk and no particular result is guaranteed.

Requires legal review: An approved warranty disclaimer and limitation-of-liability clause must be added for the confirmed legal entity and applicable jurisdictions. This paragraph is not intended to exclude rights or obligations that cannot lawfully be excluded.

Governing law and contact

Requires legal review: Add the approved governing law, venue or dispute process, legal notice address, and contact method. Do not infer these terms from the `.ca` domain or the location of a website visitor.

Changes

The reviewed date will change when these terms are materially revised. Where required, additional notice or consent should be provided before revised terms apply.
